White House Advisor Certain of Legality of Drug Price Negotiations

Pharmaceutical companies challenge the administration in court over negotiations by Medicare.

White House Domestic Policy Council Director Neera Tanden expressed confidence in the legality of Medicare’s new program that allows the agency to negotiate drug prices with pharmaceutical companies. Last week, the administration announced the first 10 drugs Medicare will begin negotiating under the program introduced by the Inflation Reduction Act.

Drug companies have filed lawsuits against Medicare, claiming that the program violates their free speech and showcases federal overreach.

“Everybody negotiates prices,” Director Tanden asserted. “What the pharmaceutical companies are doing are they’re going to the courts to ensure that they can charge any price they can get away with, and that is wrong.”
